18yo man escapes jail term for drugs

INGO Alexander Pain was 15 when he started supplying drugs in Moranbah, the Supreme Court heard yesterday.

Justice James Henry said he took two exceptions into account when handing down the sentence: the defendant's young age and his early confession.

The now-18-year-old received a wholly suspended 18-month sentence and strict three-year probation order for trafficking a dangerous drug.

The court heard it was an unrelated matter which brought police to Pain's house where they smelt burning marijuana and found a bong, a black pipe, other drug-related paraphernalia including clip-seal bags, black gunpowder and shotgun shells.

While being questioned Pain admitted to supplying different illicit dangerous drugs including ice, marijuana and speed for 18 months. He said he did it because there was not a lot of work around in Moranbah and he never really made any money from supplying.

It was estimated he had supplied drugs 30-40 times during the 18 months.

Justice Henry said it was different to come across a defendant so young who had been trafficking for such a lengthy period of time.

He said while he understood Pain had been through the trauma of losing his mother at a young age that was no excuse for him falling into bad habits.

"You have to appreciate Mr Pain you are not alone having to experience devastating life events," Justice Henry said.

Justice Henry said he hoped the long probation period and strict conditions would assist Pain with his rehabilitation.
