Alleged rape victim to be cross-examined in Roma court

AN ALLEGED rapist is set to have his committal hearing in the coming months, but his lawyers have doubts over the accuracy of the victim’s claims.

The mature-aged defendant, who cannot be named for legal reasons, faced the Roma Magistrates Court on October 29 for a charge of rape, with an extra sexual assault charge being considered.

Barrister Daniel Caruana, on behalf of the defendant's solicitor David Neuendorf, queried the court as to the nature of the complaint, given the then-17-year-old victim was potentially intoxicated.

“Her narrative is so intrinsically linked between how woozy she was,” Mr Caruana told the court.

But police prosecutor Sergeant Heather Whiting disagreed that the victim needed to be cross examined, given that a certificate of analysis exists.

“Prosecutions still believe she was quite consistent,” sergeant Whiting said.

Magistrate Peter Saggers said the hearing was, “an application by [the defendant] for the complainant… to attend court to be cross examined at a committal hearing.”

“The topics proposed for cross examination are set out by notice.”

The committal hearing is set to go ahead on January 21.
