FALLEN AFL premiership player Ben Cousins has been acquitted of an outstanding meth possession charge after prosecutors conceded they did not have enough evidence.

Cousins, 38, appeared in Fremantle Magistrates Court on Friday via video link from prison after a hearing set down for June was brought forward. After the prosecution admitted it did not have enough evidence to convict Cousins, the magistrate had to find the former Eagles captain not guilty of possessing a prohibited drug.

It comes after the Brownlow medallist and former Eagles captain was involved in a minor assault at a West Australian jail, with his lawyer Michael Tudori telling AAP it had nothing to do with him refusing to take part in a football match as had been widely reported.

Cousins was reportedly been attacked in a Perth prison for refusing to take part in an inmate footy match.

The former footy player was "set upon" by a group of prisoners, sports journalist Damian Barratt reported on Thursday evening.

Cousins was said to have been targeted by inmates after rejecting a recent invitation to play in an in-house scratch match.

"We have had it confirmed that he indeed was assaulted by inmates," Barrett told the Footy Show audience. The prison refused to comment on Cousins' detention.

The former premiership player has been behind bars for more than seven weeks after he was sentenced to 12 months jail in late March for causing "ongoing terror" to his ex-partner.

Before he went to jail, Cousins told News Corp Australia in December last year that he was "living out of a backpack", and was "having a bit of a tough time".

"It's hard to know where to go to," he said.

"I am living out of a backpack at the moment.

"I move between three mate's houses, spend time on different couches. There's a lady I knock around with these days who I stay with, otherwise I just move on to another place."

Back then, Cousins had spent two nights in police custody after he breached a domestic violence order brought by his former partner and the mother of his two children, Maylea Tinecheff.

The 38-year-old meth addict is serving a one-year prison sentence after he pleaded guilty to stalking and repeatedly breaching the order taken out by his ex-partner.

Cousins' heavy use of drugs including ice, cocaine and pills, has caused a deep rift in his family.
