Breast cancer gene cannot be patented, High Court rules

A QUEENSLAND woman has won a High Court case confirming companies cannot own the patent for the "breast cancer gene".

Brisbane grandmother and cancer survivor Yvonne D'Arcy won the case against Myriad Genetics, arguing genes could not be invented.

The High Court overturned two previous rulings in favour of the company, ruling in Mrs D'Arcy's favour on Wednesday.

Myriad Genetics had argued it held the patent over the genes BRCA-1 and BRCA-2, genes which could increase the chances of women getting cancer.

Ms D'Arcy said it would make testing for the gene cheaper for all women.
