Drunk designated driver busted after crashing into fence

NO ONE could accuse Toowoomba man Bevan Francis Robert Sly of not following his employer's lead.

The 24-year-old Centenary Heights resident appeared before the Toowoomba Magistrates Court yesterday to plead guilty to a drink-driving offence arising from after work drinks.  

The court heard Sly had blown a breath/alcohol level of 0.159 after crashing the car he was driving through a white picket fence in front of an Alderly St residence late on the night of April 27.  

Police prosecutor Sergeant Mike Robinson told the court when spoken to by police at the scene, Sly had told officers he had had "four or five Fourex beers" before driving.  

Defence lawyer Peter Sloane told the court his client instructed he had actually been the designated driver for his boss in recent times after his employer lost his driver's licence for similarly drink-driving some time ago.  

On this particular occasion his client had been having after work drinks with his boss but had had too many before driving, he said.  

His client would now have to hire a driver for himself to get him around for work during the driving disqualification period, Mr Sloan submitted.  

His client had also had discussions with the home owners and had arranged to fix the picket fence and a bird bath that had been damaged after the car went through the fence that night, he told the court.  

Magistrate Bruce Schemioneck said he would take into account Sly's early plea of guilty, the fact that he had no previous history and that he had already been without his driver's licence since the incident.  

Mr Schemioneck said, in the circumstances, he would reduce to the driving disqualification period to the mandatory minimum of six months but increase the fine to $1500.
