Government bungle: 24 magistrates took wrong oath

PARLIAMENT has rushed through new legislation after discovering new magistrates and acting magistrates, including those in Bundaberg, Gladstone and Kingaroy, have taken the wrong oath or affirmation.

Twenty-four magistrates or acting magistrates from across the state made the mistake when being sworn in between April 12, 2013, and April 24 this year.

They accidentally used the 2003 oath or affirmation.

Both sides of parliament agreed it was necessary to rush the laws through.

Attorney-General Yvette D'Ath said the error was discovered last week.

Before the legislation was passed, she warned the administrative bungle might impact the validity of judicial appointments.

But she said the administration of the incorrect oath or affirmation had no effect on the legal correctness or orders judicial officers made.
