Judge allows rehearing for court no-show car chase accused

A MAN who was sentenced to jail after failing to attend court on charges relating to an alleged police chase can have his case reheard. 

Coed'y Andrew Kleinig was charged with dangerous operation of a motor vehicle, failure to stop a motor vehicle, trespass and wilful trespass following an incident at Blackwater on September 12, 2014.

Police alleged the 22-year-old refused to leave his vehicle after officers saw someone acting strangely at an industrial estate in Blackwater, between Rockhampton and Emerald.

The accused allegedly took off in a Nissan ute, narrowly missing a police officer who asked him to leave his car.

Police say they chased the car along Turpentine St and onto the Capricorn Hwy for 2km before stopping the accused and arresting him.Mr Kleinig was bailed to appear in court on October 9, but he did not show up.

The magistrate decided to hear the matter without him and sentenced Mr Kleinig to six months jail, suspended after three months.

He also disqualified Mr Kleinig from driving for four years.The magistrate adjourned the case for further mention on October 23 to allow Mr Kleinig a chance to appear before the court.

Mr Kleinig did not show up again so the sentence was upheld and a warrant was issued.When police caught up with Mr Kleinig on January 21, he said he put a wrong address on his bail forms and therefore didn't hear about the court dates.

The Brisbane District Court on November 27 allowed Mr Kleinig's request to have the matter reheard.

Judge Deborah Richards said the magistrate was unable to take into account Mr Kleinig's personal circumstances, any mitigating factors and a range of other areas when sentencing him.
