‘Leave their pumpkins alone’ says magistrate

"YOU can't go 'round knocking people's pumpkins off... or their watermelons."

Magistrate Damien Dwyer said this to a man charged with trespassing through a business yard on Old Foulden Rd to reach the property next door.

While there Mark William Pendleton took a pumpkin and a watermelon.

It was about 4pm on January 15 this year.

He was caught on the business property on his way back and the police were called, the Mackay Magistrates Court was told yesterday.

The food items were returned.

The 49-year-old Mackay man pleaded guilty in the Magistrates Court to trespassing and possessing suspected stolen items.

The court heard he'd been diagnosed with a medical condition and had been depressed.

He co-operated with police by admitting his actions.

Pendleton was fined $75 and a conviction was not recorded.

"Leave their pumpkins alone... and their watermelons," Mr Dwyer said.
