Repeat drug offender caught with multiple cannabis plants

A ST George man with a lengthy criminal history consisting of multiple drug offences has pleaded guilty in court for possession of drugs and property used in connection of a drug offence.

St George Magistrates Court heard on Tuesday that police executed a search warrant a Shane Lesley Smith’s home at 12.15pm on May 29.

Police prosecutor sergeant Heather Whiting told the court that during the search, St George police located two clipsal bags which had two smaller bags inside containing two cannabis plant stems and a red straw that had been cut down.

Police located a second clipsal bag which contained 11 cannabis plant stems.

Smith denied ownership of the drugs and said to police he didn’t know who they belonged to.

Sgt Whiting said the defendant put his plea in writing on August 24, however prosecution would not accept it because the last four entries on his criminal history were all drug related.

“Prosecution would submit perhaps a short period of probation is actually appropriate given the circumstance,” Sgt Whiting said.

Magistrate Tracy Mossop read to the court Smith’s drug related offences occurred in 2014, 2016, 2019 and this year.

“Here we are yet again,” she said.

“There comes a point in time, where you need to consider what you’re doing with drug use.

“Because it’s marijuana, I’ll place you on the shortest probation I can.

“But with your drug history, I want you to do something to address it.”

The magistrate released Smith under the watch of a community corrective services officer for 6 months and the conviction was recorded.

Magistrate Mossop added a special condition to the probation order, that Smith attend relevant drug counselling and rehabilitation programs during the six months.

“All the best and I hope I don’t see you again,” the magistrate said.
