Toowoomba workplace death case back before court

A MAN charged in relation to a fatal workplace accident in Toowoomba has had his case adjourned again in the city's Magistrates Court.

Jameson Nathan Boon is charged with dangerously operating a vehicle causing the death of work colleague Simon Poxon on the grounds of Sherrin Rentals in Toowoomba on February 26, 2013.

The 25-year-old has not been required to enter any plea to the charge and was not required to be in court for yesterday's mention of the matter.

Members of Mr Poxon's family were in court watching proceedings and were there to hear defence solicitor Nathan Bouchier ask for an adjournment.

Mr Bouchier said the defence was still considering whether or not to apply for a pre-trial committal hearing which could include cross examination of certain case witnesses.

Investigators claim Mr Poxon died as a result of injuries sustained when he was pinned between a truck and a knuckle boom at the Torrington worksite.

Should the matter eventually go to trial it is expected to be heard in the Toowoomba District Court.

Magistrate Damian Carroll acceded to Mr Bouchier's request and adjourned the case for mention back in the same court on March 21.

The defendant remains on bail.
