Drunk man urinates on Gympie war memorial, fined $1000

A TRAVESTON man who desecrated Gympie's Mary St war memorial by urinating on it while drunk was fined heavily in Gympie Magistrates Court yesterday.

Ty Ashley Chippendale, 24, who was incongruously charged with "interfering with graves", was unlucky to be in the presence of police when his drunk and disrespectful actions were witnessed late at night on September 11.

The court heard police had been called to Mary St earlier in the evening when the intoxicated man failed to leave Billy's Hotel after being refused entry.

Police described the drunken male as "argumentative, belligerent and full of excuses for not leaving the premises".

He was given a Move on Direction and not allowed to return within 100m of Billy's Hotel for the next five hours.

Chippendale left the area in a taxi, but half an hour later was found sitting on a bench near the hotel by police.

Gympie police prosecutor Sergeant Michael Phillips said when police approached Chippendale he told them he was "going to pee on the memorial".

The police strongly advised him not to, but then saw a "puddle of liquid that strongly smelt of wee".

Sgt Phillips said the police were outraged when they saw his actions.

"The police were incensed at the conduct of the defendant, telling him that they considered this offence to be abhorrent and most serious," Sgt Phillips said.

Defence lawyer Pat Horgan told the court the young roofing apprentice was extremely remorseful and embarrassed by his actions.

"This incident is largely out of character for him," Mr Horgan said; adding his client had not been out to the Gympie nightclubs since and had no intention of returning.

Magistrate B. Barrett said while Chippendale's behaviour could be explained by alcohol, it was never an excuse.

"Urination on the war memorial is something the community in general takes a dim view of, as does the court," he said.

Mr Barrett fined the man $1000 for the offence and recorded a conviction against him.
